1Acceptance of Terms

By downloading, installing, accessing, or using the DearDays mobile application ("the App", "the Service"), provided and published by Akhand Pratap Singh("Developer", "we", "us", or "our"), you agree to be legally bound by these Terms and Conditions ("Terms") and our Privacy Policy.

If you do not agree to all terms and conditions set forth herein, you must immediately refrain from downloading, installing, or using the application. Continued use of DearDays constitutes binding acceptance of these Terms and any future updates.

2License Grant & Permitted Use

We grant you a personal, revocable, non-exclusive, non-transferable, and limited license to download, install, and execute DearDays on compatible Android devices for your personal, non-commercial entertainment and creative purposes.

3User Generated Content & Intellectual Property

4Offline Processing & Local Storage / Backup Responsibility

• The developer does not operate remote cloud backup servers for your photos, text styles, or memories.
• We are not liable for any data loss resulting from hardware malfunction, operating system updates, app uninstallation, clearing device cache/storage, or device theft.
• You are strongly encouraged to maintain regular backups of important photos and memories on your own personal external storage or private cloud service.

5Advertisements & Third-Party Services

DearDays displays advertisements delivered by Google AdMob and may utilize Google Firebase for crash diagnostics and performance telemetry to support ongoing maintenance, detect software bugs, and optimize feature reliability.

• Advertisements may link to external websites, apps, or services not owned or operated by the developer.
• We do not endorse, sponsor, or assume any responsibility for third-party products, services, or content.
• Any transactions, communications, or dealings between you and advertisers found through the App are solely between you and the respective third party.

6Disclaimer of Warranties

DearDays is provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

Camera viewfinder quality, filter processing speed, and AI visual framing guidance depend directly on your device's physical camera sensors, GPU capabilities, and Android hardware specifications. We do not warrant that the App will function error-free on every Android handset model.

7Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Akhand Pratap Singh, affiliates, partners, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages (including but not limited to loss of photos, loss of data, loss of profits, business interruption, or device failure) arising out of or related to your use of or inability to use DearDays.

8Modifications & Termination

We reserve the right to modify or replace these Terms at any time. Continued use of the App following changes constitutes acceptance of the modified Terms. We also reserve the right to modify, suspend, or discontinue any feature, filter, tool, or aspect of DearDays at our discretion without prior notice. You may terminate these Terms at any time by uninstalling the application and ceasing all use.

9Governing Law & Jurisdiction

These Terms and any dispute arising out of or related to your use of the App shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any legal proceeding arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in India.
